Short sale vs the auction

At the auction you are not the seller in any way that helps you. The trustee calls it. Fees are already stacked. If there is surplus, it is not the check people imagine. If there is a deficiency, you may still owe. That is not a clean ending.

A short sale is a purchase from you before that happens. The lender has to approve a short payoff. You convey title. The file can end with a release. That is a clean sale when the lender actually closes it that way. We are the buyer, not your agent. We do not promise a waiver.

Start before a Fort Bend posting. After the notice of sale, the first Tuesday is the calendar. Short sale buyer. Will the lender approve a short sale. The auction will not cut you a check.

What the statute actually says

The auction is Property Code § 51.002 — a public sale you do not price. Leftover debt after that sale is a deficiency question under § 51.003. Fees are already stacked.

A short sale is a purchase from you before that statute is used. The lender has to approve a short payoff. Regulation X tells the servicer how to process a complete application — 12 C.F.R. § 1024.41 — it does not make them take our number. Start before the 21-day notice. After it, the first Tuesday is the calendar.
